Environmental Health Officers Trustees Approach Court to Stop Elections and Demands Dissolution of National Executives Officers
The Environmental Health Officers Association of Nigeria and its National Executive Officers have been dragged before an Abuja Federal High Court, Court No.8, presided over by the Honourable Justice Ojukwu
The plaintiffs are seeking the following reliefs;
A DECLARATION that by the Defendants 2003 Constitution, the tenure of office of the National Officers had validly elasped and their continuous occupation of office, tenures, actions and functinos are unconstitutional, illegal, null and void and a violation of the Associations Constitution
The plaintiffs through an originating summons instituted on the 6th of November 2017 by its lawyer wilson Ivara, is also seeking for an order directing all National Executive Officers to vacate forthwith the National Offices occupied by them and to immediately handover to the board of trustees led by Mr. Moses Aniefiok
Other reliefs sought by the plaintiffs are; AN ORDER directing all the National Officers to pay back into the accounts of the association all moneis, dues and leveies collected in the name of the Association during the period of their illegal occupation of their National offices between 2010 till date
The plaintiffs are equally seeking AN ORDER OF PERPETUAL INJUNCTION RESTRAINING the National Officers jointly and severaly from further ocupying National offices, spending moneis of the Association and or conducting an Annual General Meeting anywhere in Nigeria
The plaintiffs in a seperate application dated the 17th of November are seeking an ORDER OF INTERLOCUTORY INJUCTION restraining all the National officers jointly and severally from holding, organizing or conducting an Annual General Meeting of the Association anywhere in Nigeria pending the hearing and determination of the substantive suit
Hearing is fixed for the 29th of November 2017
